BACK & NECK INJURIES

Legal Help With Herniated Disk Injuries After An Accident

Back and neck injuries are extremely common in automobile accidents. Our attorneys have a great deal of knowledge gained from handling hundreds of these cases and talking to injured clients, their families, and various medical specialists including orthopedists, neurosurgeons, physiatrists, chiropractors, and physical therapists. These cases can be very challenging because members of the general public often do not appreciate the extent and debilitating nature of these injuries. Our recent trial verdicts have been excellent in this area.

Spinal disk injuries often occur as a result of a serious car or truck collision. In the Gainesville and Marion County areas of Florida, the attorneys at Fine, Farkash & Parlapiano, P.A., have represented many people with this type of serious injury and have gained familiarity with cases where back or neck injuries have occurred.

Your body’s initial response to a vehicular collision is the production of adrenaline. Adrenaline, a powerful hormone, can cause a feeling of euphoria that covers up your perception of serious injury. This is a natural human response that makes us able to fight or flee from a dangerous situation. But many confuse this initial response and assume they aren’t really injured. It is important to see a medical professional if symptoms of a disk or whiplash injury occur. Self-diagnosis, diagnosis from friends, relatives or lawyers is no substitute for a visit to a qualified physician in regards to your neck or back injury.

Although there are a number of different tests to determine a disk injury, the “gold standard” is most often an MRI. This is an expensive test and must be ordered by a qualified medical professional after an appropriate examination and history. If the MRI, CT, or other appropriate test shows a bulging or herniated disk, a referral to a neurosurgeon or orthopedic surgeon may be appropriate. It should be emphasized again that prompt examination by a qualified doctor is important because disk injuries, if untreated, can produce serious permanent harm.

A serious back injury can cause pain and suffering, weight gain due to inactivity, missed work, lost wages and lost future income. A common indication of a disk injury is pain in the neck (cervical) area that can radiate into the upper extremities (arms) or pain in the lower back (lumbar) area that can radiate into the lower extremities (legs).

Florida law generally requires that your own car insurance (PIP) pay 80 percent of your medical bills and 60 percent of your lost wages.
